Terms of Service

These Terms of Service (“Terms”) govern your use of the Wetapoint platform, including our website, mobile applications, and APIs (together, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Wetapoint is a real-time, map-based operations management platform. It coordinates field teams during events, security operations, outdoor activities, and similar use cases — including live GPS tracking, task assignment, incident management, messaging, push-to-talk radio, live video streaming, camera feeds, and analytics.
The Service is provided by MB "Wetapoint", Papiškių g. 19-1, LT-06282 Vilnius, Lithuania.
2. Business use
The Service is offered solely for business and organisational use. By creating an account you confirm that you are acting on behalf of a company, organisation, public body, or other professional activity — not as a consumer — and that you have authority to bind that organisation to these Terms.
3. Account registration
- You must provide accurate information at registration and keep it current.
- You are responsible for all activity under your account, including users you invite.
- You must be at least 16 years old to create an account.
4. Your content
You retain ownership of all content you submit (“Customer Data”). You grant us a worldwide, royalty-free licence to host, store, transmit, and display it solely to provide the Service.
Where Customer Data includes personal information about third parties, you confirm you have a lawful basis to collect it and have informed those individuals as required. The data-processing relationship is governed by our Data Processing Addendum.
5. Acceptable use
You agree not to use the Service to violate any law, track individuals without consent and lawful basis, distribute malware, attempt unauthorised access, resell the Service without written consent, or build a competing product. Full details are in our Acceptable Use Policy.
6. Subscriptions and fees
Paid plans are billed in advance via Stripe. We may change plan structure and pricing on 30 days' notice. Prices exclude applicable taxes (VAT, GST, sales tax), which are added to your invoice where required.
If a payment fails, we may retry and then suspend the account until payment is restored.
7. Cancellation and refunds
You may cancel at any time from inside the Service. Your subscription remains active until the end of the current paid period. We do not pro-rate.
We offer a 14-day refund window from the first payment per organisation. After that window, fees are non-refundable except where required by law. See our Refund Policy for details.
8. Service availability
We work to keep the Service available 24/7 but do not guarantee uninterrupted availability. Planned maintenance will be announced in advance where reasonably possible.
9. Termination
- By you: cancel at any time. Access continues to end of paid period.
- By us, with notice: 7 days' written notice for any reason.
- By us, immediately: for material breach (non-payment, abuse, security violation).
After termination or deactivation, your organisation's administrators retain export-only access to Customer Data for 30 days. When that window ends, an automated process permanently deletes Customer Data from primary storage, keeping only a minimal billing and audit record. Copies in encrypted off-site backups age out on the rolling snapshot schedule described in the Privacy Policy (up to approximately six months).
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
Wetapoint is a coordination tool. You are responsible for ensuring that your use is appropriate for your operational context. We make no representations about suitability for safety-of-life, medical, military, or other high-stakes applications.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUES, GOODWILL, OR DATA; OR THE COST OF PROCURING SUBSTITUTE SERVICES.
Our aggregate liability is capped at the lower of (a) the amount you paid us in the 12 months preceding the event, or (b) EUR 1,000.
Nothing in these Terms limits liability that cannot be excluded under applicable law (death or personal injury caused by negligence, fraud).
12. Indemnity
You will indemnify and hold us harmless from any third-party claim arising from (a) your Customer Data, (b) your breach of these Terms, or (c) your violation of applicable law.
13. Force majeure
Neither party is liable for failure to perform obligations caused by events beyond reasonable control, including natural disasters, government actions, epidemics, war, terrorism, internet or power failures, or labour disputes.
14. Governing law
These Terms are governed by the laws of the Republic of Lithuania. The courts of Vilnius have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
15. Changes to these Terms
Material changes will be announced by email at least 30 days before taking effect. A banner will appear in the Service. Continued use after the effective date constitutes acceptance.
16. Miscellaneous
- If any provision is unenforceable, the remainder stays in effect.
- Our failure to enforce a provision is not a waiver of our right to do so later.
- These Terms, together with the Privacy Policy, DPA, and any order form, are the entire agreement.
